NOTICE OF TRUSTEE’S SALE

I. NOTICE IS HEREBY GIVEN that the undersigned Trustee will on Friday, the 10th day of January, 2014, at 10:00 a.m. on the front steps of the Pacific County Courthouse, 300 Memorial Drive, in the City of South Bend, State of Washington, sell at public auction to the highest and best bidder, payable at time of sale, the following described real property, situated in the County of Pacific, State of Washington, to-wit: That portion of Section 9, Township 12 North, Range 11 West of W.M., Pacific County, Washington, described as follows: Beginning at the Northeast corner of Government Lot 4 of Section 9, Township 12 North, Range 11 West of W.M.; Thence on Lambert Bearings North 86° 41’10” West 21.16 feet; Thence North 459.24 feet to the point of beginning; thence continuing North 442.04 feet; thence North 86° 41’10” West 515.97 feet; thence South 05° 48’35” East 446.96 feet; thence South 86° 41’10” East 470.66 feet to the point of beginning and being a portion of Parcel 2 of the Survey of Espy Lake Tracts filed in Volume 4 of Surveys at page 27, records of Pacific County, Washington. Situate in the County of Pacific, State of Washington. Assessor’s Property Tax Parcel A: 12110941051; commonly known as 32604 Y Lane, Ocean Park, WA 98640; which is subject to that certain Deed of Trust dated October 3, 2007, recorded October 9, 2007, under Auditor’s File No. 3106890, records of Pacific County, State of Washington, from Robbert F. Warner, as Grantor, to PACIFIC COUNTY TITLE COMPANY, as Trustee, to secure an obligation in favor of GREAT NORTHWEST FEDERAL CREDIT UNION, as beneficiary. The undersigned, Jack B Micheau, has been appointed as successor trustee by a document dated August 16, 2013, and recorded on August 19, 2013, under Auditor’s File No. 3147383. II. No action commenced by the Beneficiary of the Deed of Trust is now pending to seek satisfaction of the obligation in any Court by reason of the Borrrower’s or Grantor’s default on the obligation secured by the Deed of Trust. III. The default(s) for which this foreclosure is/are made as follows: 1) Failure to make any monthly payment owing since March 5, 2013 and any monthly payments since March 5, 2013, failure to pay the real estate property taxes. Failure to pay when due the following amounts, now in arrears: Scheduled remaining principal as of August 15, 2013: currently due to reinstate on 01/10/2014 $177,413.48; estimated amount that will be due to reinstate on 12/31/2013; Per diem interest on principal from 03/05/2013 at $35.77 per day (311 days through 01/10/2014): currently due to reinstate on 01/10/2014 $11,124.47, estimated amount that will be due to reinstate on 12/31/2013 $10,731.00; 2013 property taxes: currently due to reinstate on 01/10/2014 $3,558.34, estimated amount that will be due to reinstate on 12/31/2013 $3,558.34; Late fees-Monthly @ $40.79: currently due to reinstate on 01/10/14 $407.90, 2014, estimated amount that will be due to reinstate on 12/31/2013 $367.11; Title Report: currently due to reinstate on 01/10/14 $514.90, estimated amount that will be due to reinstate on 12/31/2013 $514.90; Attorney’s Fees for Non-Judicial Foreclosure: currently due to reinstate on 01/10/14 $1,500.00, estimated amount that will be due to reinstate on 12/31/2013 $1.500.00; Estimated other costs of Non-Judicial Foreclosure: currently due to reinstate on 01/10/14 $1,500.00, estimated amount that will be due to reinstate on 12/31/2013 $1.500.00; TOTALS: Currently due to reinstate on 01/10/14 $196,019.19, Estimated amount that will be due to reinstate on 12/31/2013 $195,584.93. IV. The sum owing on the obligation secured by the Deed of Trust is: Principal $177,413.58, together with interest as provided in the note or other instrument, secured from the date of August 15, 2013 for a total amount owing of $188,538.05 through January 10, 2014, and such other costs and fees as are due under the note or other instrument secured, and as are provided by statute. V. The above-described real property will be sold to satisfy the expense of sale and the obligation secured by the Deed of Trust as provided by statute. The sale will be made without warranty, express or implied, regarding title, possession, or encumbrances on January 10, 2014. The default(s) referred to in paragraph III, together with any subsequent payments, late charges, or other defaults must be cured by December 31, 2013 to cause a discontinuance of the sale. The sale will be discontinued and terminated if at any time on or before December 31, 2013 (11 days before the sale date), the default(s) as set forth in paragraph III, together with any subsequent payments, late charges, or other defaults, is/are cured and the Trustee’s fees and costs are paid. Payment must be in cash or with cashier’s check or certified checks from a State or federally chartered bank. The sale may be terminated any time after December 31, 2013, and before the sale by the Borrower, Grantor, any Guarantor or the holder of any recorded junior lien or encumbrance paying the entire principal and interest secured by the Deed of Trust, plus costs, fees, and advances, if any, made pursuant to the terms of the obligation and/or Deed of Trust, and curing all other defaults. VI. A written Notice of Default was transmitted by the beneficiary or Trustee to the Borrowers and Grantors at the following address: PO Box 731, Ocean Park, Washington 98640 by both first class and certified mail on August 22, 2013, proof of which is in the possession of the Trustee; and the Borrower and Grantor were personally served on August 30, 3013, with said Notice of Default or the written Notice of Default was posted in a conspicuous place on the real property described in paragraph I above, and the Trustee has possession of proof of such service or posting. VII. The Trustee whose name and address are set forth below will provide in writing to anyone requesting it a statement of all costs and fees due at any time prior to the sale. VIII. The effect of the sale will be to deprive the Grantor and all those who hold by, through or under the Grantor of all their interest in the above-described property. IX. Anyone having any objection to this sale on any grounds whatsoever will be afforded an opportunity to be heard as to those objections if they bring a lawsuit to restrain the sale pursuant to RCW 61.24.130. Failure to bring such a lawsuit may result in a waiver of any proper grounds for invalidating the Trustee’s sale.
