PHH MORTGAGE CORPORATION, its in interest and/or assigns, Plaintiff, vs. UNKNOWN HEIRS AND DEVISEES OF DALE L. INGALLS, DECEASED; CHERYL JENNESS; CINDY SCHMIDT; TIM INGALLS; TODD INGALLS; APRIL INGALLS; WASHINGTON STATE DEPARTMENT OF SOCIAL AND HEALTH SERVICES; Occupants of the Premises; also all other persons or parties unknown claiming any right, title, estate, lien, or interest in the real estate described in the complaint herein, Defendants.

TO: UNKNOWN HEIRS AND DEVISEES OF DALE L. INGALLS, DECEASED; OCCUPANTS OF THE PREMISES; ALSO ALL OTHER PERSONS OR PARTIES UNKNOWN CLAIMING TO HAVE ANY RIGHT, TITLE, ESTATE, LIEN OR INTEREST IN THE REAL PROPERTY DESCRIBED IN THE COMPLAINT, Judgment Debtors.

A Writ of for Order of Sale has been issued in the above-captioned case, directed to the Sheriff of Pacific County, commanding the Sheriff as follows: On March 6, 2013, a Judgment and Decree of Foreclosure (“Judgment”) was entered in favor of PHH Mortgage Corporation (“Plaintiff”) against the Defendants Unknown Heirs and Devisees of Dale L. Ingalls, deceased; Cheryl Jenness; Cindy Schmidt; Tim Ingalls; Todd Ingalls; April Ingalls; Washington State Department of Social and Health Services; Occupants of the Premises; and any persons or parties claiming to have any right, title, estate, lien or interest in the real property described in the complaint (“Defendants”). The Judgment forecloses the interests of all the Defendants in and to the following described property (“Property”) commonly known as 164 Ward Creek Road, Raymond, WA 98577 for the total sum of $74,143.16 with interest thereon at the rate of 7.375% per annum from March 6, 2013. The Property situated in Pacific County, State of Washington, is legally described as: BEGINNING AT THE SECTION COMMON TO SECTION 14, 15, 22 AND 23, TOWNSHIP 14 NORTH, RANGE 8 WEST, W.M., PACIFIC COUNTY, WASHINGTON; THENCE WITH THE FOLLOWING WASHINGTON STATE SOUTH ZONE AZIMUTH’S AND DISTANCES, 183° 06’ 57’ 2662.65 FEET TO THE QUARTER CORNER COMMON TO SECTIONS 22 AND 23, TOWNSHIP 14 NORTH, RANGE 8 WEST, W.M.; THENCE 335° 00’ 05” 1308.48 FEET TO A POINT ON THE EASTERLY RIGHT OF WAY LINE OF THE WARD CREEK COUNTY ROAD AND THE TRUE POINT OF BEGINNING OF THIS DESCRIPTION; THENCE 108° 35’ 50” ALONG AN EXISTING FENCE, A DISTANCE OF 133.53 FEET TO AN EXISTING FENCE CORNER; THENCE 192° 47’ 27” 89.80 FEET; THENCE 172° 50’ 26” 42.29 FEET TO THE CENTERLINE OF FAIRCHILD CREEK, AKA WARD CREEK; THENCE WITH THE FOLLOWING AZIMUTH’S AND DISTANCES ALONG THE CENTERLINE OF FAIRCHILD CREEK 201° 23’ 10” 74.27 FEET; THENCE 179° 48’ 02” 216.86 FEET; THENCE 269° 02’ 06’ 135.04 FEET TO THE INTERSECTION OF THE FAIRCHILD CREEK AND THE EASTERLY RIGHT OF WAY OF THE WARD CREEK COUNTY ROAD; THENCE NORTHERLY ALONG SAID EASTERLY RIGHT OF WAY LINE, A DISTANCE OF 464.27 FEET, MORE OR LESS TO THE POINT OF BEGINNING. THEREFORE, pursuant to RCW 61.12.060, and in the name of the State of Washington, you are hereby commanded to sell the Property, or so much thereof as may be necessary, in order to satisfy the Judgment, including post-judgment interest and costs. MAKE RETURN HEREOF within sixty days of the date indicated below, showing you have executed the same. Pursuant to RCW 6.21.050(2), the Sheriff may adjourn the foreclosure sale from time to time, not exceeding thirty days beyond the last date at which this Writ is made returnable, with the consent of the plaintiff endorsed upon this Writ or by a contemporaneous writing. WITNESS the Honorable Michael Sullivan, Judge of the Superior Court and the seal of said Court affixed this 11th day of June, 2013, at South Bend, Washington. THIS WRIT SHALL BE AUTOMATICALLY EXTENDED FOR 30 DAYS FOR THE PURPOSES OF SALE. The sale date has been set for Friday, August 23, 2013, at 10 a.m. at the Main Entrance of the Pacific County Courthouse in South Bend, Washington. YOU MAY HAVE A RIGHT TO EXEMPT PROPERTY from the sale under statutes of this state, including sections 6.13.010, 6.13.040, 6.15.010, and 6.15.060 of the Revised Code of Washington, in the manner described in those statutes.
